Foreigner missing or presumed dead:

(1) If it is presumed that a foreigner has disappeared or died, it shall be determined according to the law of the country of citizenship of such a person.
(2) According to sub-section (1), if the citizenship of a foreigner cannot be ascertained, it shall be determined according to the law of the country where he has his usual residence and if such residence cannot be ascertained, his disappearance or death shall be determined according to the law of the country of his immediate residence.
